Patent Registration in China for Israeli Companies: CNIPA Invention Patent Guide

China can be a critical patent jurisdiction for an Israeli technology company that manufactures products there, supplies Chinese customers or faces competitors producing similar goods in China. A patent in Israel or the United States does not automatically prevent unauthorized manufacture or sale in mainland China. Securing enforceable Chinese rights requires a filing and examination strategy under China’s own patent legislation.

This guide focuses on Chinese Invention Patents, the route for qualifying technical inventions that undergo substantive examination before the China National Intellectual Property Administration (CNIPA). It explains the differences from utility models and designs, direct filing versus PCT national phase, Chinese-language documents, deadlines and specific issues affecting cross-border R&D.

Three Types of Chinese Patent Protection

The Chinese Patent Law recognizes invention patents, utility models and designs. An invention patent may cover a qualifying new technical solution concerning a product, process or improvement. A utility model generally concerns a technical solution relating to the shape or structure of a product, or their combination. A design patent protects qualifying visual aspects of a product and is distinct from protection of a technical operating principle.

The choice depends on the actual innovation. A new control method for an irrigation system may justify considering an invention patent. A mechanically improved valve could require a different analysis, potentially including utility-model protection. The fact that the invention contains software does not make it automatically unpatentable, but an abstract algorithm or business rule is not necessarily a qualifying technical solution.

For a focused discussion of the alternative protection route, see Utility Model Patents in China.

Requirements for an Invention Patent in China

Article 22 of the Chinese Patent Law sets out the principal criteria of novelty, inventiveness and practical applicability. The novelty assessment considers relevant prior art made publicly available worldwide before the relevant date, including published applications and technical literature. An expired patent may still count as prior art even though its enforceable rights have ended.

Inventiveness requires more than finding a combination not expressly disclosed in one document. The claimed differences are assessed under the Chinese standard for prominent substantive features and notable progress, which is not necessarily identical to the test applied to a utility model.

The applicant must also comply with subject-matter restrictions and the specification requirements of the Chinese law, including clear claims supported by adequate disclosure. Public disclosures before filing may destroy novelty. China has limited statutory exceptions, but Israeli businesses should not assume that every trade exhibition, investor pitch or online demonstration falls within them.

Example: An Israeli Agricultural Technology System

Suppose an Israeli agri-tech company develops a greenhouse-control system combining moisture and temperature sensors, remote controllers and electronically operated irrigation valves. Conventional systems activate a valve when a sensor crosses a threshold, but the new system uses a synchronized sequence of controller acknowledgments to prevent repeated watering after communication is restored.

The patent attorney should identify whether the claimed technical improvement lies in the ordering of decisions, the restoration sequence, the valve-control conditions or a specific combination. Each claimed feature should be compared with prior publications and described in enough detail to support the requested protection.

If the same company separately develops a new quick-release physical valve configuration, a utility-model review may also be worthwhile. The two innovations should not be conflated. This example is hypothetical and is not an assessment that either concept is new or patentable.

Direct Chinese Filing or PCT National Phase?

An Israeli company can pursue an invention patent in China by direct filing before CNIPA, including a qualifying Paris Convention priority claim from an earlier application, or by entering the Chinese national phase from a PCT application. Both ultimately lead to Chinese procedures governed by local law.

For a direct filing claiming priority from a first application abroad, the normal patent priority period is 12 months, subject to applicable rules. The earlier filing supports only subject matter adequately disclosed in it; a later addition cannot simply acquire the earlier date by being included in the new Chinese application.

For PCT applicants, the international phase provides a search and a period to choose markets, but it does not confer a Chinese patent. The applicant must enter the Chinese national phase and meet the requirements for translation, representation and payment. See PCT Patent Applications for Israeli Companies.

PCT Entry into China: Generally 30 Months, Not 31

For China, the usual PCT national-phase deadline is 30 months from the relevant priority date. In certain circumstances Chinese practice permits completion during a further period of up to two months upon payment of the prescribed surcharge and compliance with the applicable requirements. This should be regarded as conditional late-entry relief, not the ordinary filing deadline.

The difference from European practice is important: EPO regional-phase entry generally has a 31-month deadline, while the standard Chinese period is 30 months. Israeli applicants filing across several territories should maintain country-specific deadline records rather than applying one global timetable.

For the current national-phase details, consult the China chapter of WIPO’s PCT Applicant’s Guide and instructions from CNIPA.

Chinese Translation and Local Patent Representation

Chinese patent prosecution is conducted in Chinese. An English or Hebrew patent application must therefore be professionally translated where required by the selected filing procedure. Consistency of technical terminology is particularly important in the claims: an overly narrow or inaccurate translation can undermine intended protection or generate discrepancies between the description, drawings and claims.

A company should involve the inventor or responsible engineer in reviewing technical terminology, and it should not assume that new technical matter omitted from the initial disclosure can be inserted through a later translation or amendment.

Foreign applicants without a habitual residence or business office in China are generally required to appoint an appropriately authorized local patent agency. Israeli counsel and the Chinese associate should coordinate claims, filing dates, the approved Chinese wording and responses to CNIPA.

Examination and Grant of an Invention Patent

Following filing, CNIPA performs preliminary checks. An invention application ordinarily becomes public after 18 months from the relevant filing date, subject to early publication mechanisms. Publication is not an indication that patentability has been confirmed or that rights have been granted.

Unlike a utility model, an invention patent requires substantive examination. Article 35 of the Chinese Patent Law generally provides for a request for substantive examination within three years from the relevant filing date; particular PCT timing rules must be checked where applicable.

During substantive examination, CNIPA may raise objections concerning novelty, inventiveness, clarity, claim support, sufficiency of disclosure and subject-matter eligibility. The applicant may respond with arguments and permissible amendments within the boundaries of the originally filed disclosure. Successful examination and completion of the applicable grant formalities can result in an invention patent.

How Long Is an Invention Patent Valid in China?

Under Article 42 of the Chinese Patent Law, the basic term of an invention patent is 20 years from the filing date. The basic utility-model term is 10 years, while design-patent protection lasts 15 years. Rights are subject to applicable maintenance fees and other legal requirements.

Chinese law also contains specified patent-term adjustment or extension mechanisms in particular circumstances, including certain examination delays and pharmaceuticals. Such provisions should not be treated as an automatic addition to the term of every invention patent.

Does a Mainland China Patent Cover Hong Kong and Macao?

A mainland Chinese invention patent does not automatically provide identical protection in Hong Kong or Macao. Those territories have separate legal and registration arrangements. Depending on the case, rights obtained in mainland China may support certain Hong Kong registration routes, but the required local steps and timing must be assessed separately.

An Israeli company planning distribution across mainland China, Hong Kong and Macao should identify those markets explicitly before filing and budget for their individual legal treatment.

What If the Invention Was Developed in China by a Foreign-Owned Company?

Foreign ownership does not alone determine whether Chinese foreign-filing secrecy requirements apply. Under Article 19 of the Chinese Patent Law and implementing rules, certain inventions or utility models whose substantive technical solution was completed in China may require a confidentiality examination by CNIPA before a patent application is filed abroad.

This issue can arise where an Israeli company works with Chinese engineers, manufacturing partners or a local research center. The parties should establish where the invention was substantively developed and address potential Chinese secrecy-review obligations before making the first foreign filing.

China Invention Patent or Utility Model?

The decision depends on whether the innovation concerns a process, control method or technical product solution, or an eligible structural improvement to a product. Substantive examination, expected protection period, speed, cost, commercial value and litigation plans may all matter.

A utility model is not simply a cheaper invention patent. It has different subject-matter restrictions and examination characteristics. Where separate aspects of a product could support different forms of protection, any coordinated filing strategy should be checked against Chinese rules concerning overlapping or double patenting.

Costs and Practical Preparation for an Israeli Applicant

Foreign filing expenses commonly include drafting, direct or PCT national-phase fees, Chinese translation, local professional fees, substantive examination, responses to official objections and annual maintenance fees. The amount depends on technical complexity, claim length, translation volume and the course of prosecution.

Before filing, the company should confirm the identity of the legal applicant, inventor assignments, the relevant technical disclosure and its original priority date. It should also consider whether it intends to manufacture in China, license Chinese factories, sell locally or enforce rights against competitors, because those business objectives affect the value of Chinese patent protection.

A patent grant does not establish freedom to operate: an improved product may still infringe an earlier third-party Chinese patent. Patentability and FTO must be assessed separately.
