An Israel trademark search is a practical first step before filing a trademark application in Israel. It can identify earlier Israeli trademark applications and registrations that may conflict with a proposed mark and can help assess whether the filing strategy, wording of goods and services, or class selection should be adjusted before an application is submitted.
The Israel Patent Authority provides a free public trademark database, and it also offers a paid search service performed by the Trademarks Department. These are useful tools, but a search result is not a guarantee that a mark will be accepted for registration. The application will still undergo substantive examination after filing.
For the complete registration procedure, see our Trademark Registration Process in Israel guide. For filing requirements, see How to File a Trademark Application in Israel.
Free Israel Trademark Database Search
The Israel Patent Authority maintains an online database that can be searched without charge. The English-language interface allows users to search Israeli trademark records using fields such as the mark number, international registration number, words appearing in the mark, owner name, attorney name, application and registration dates, mark type, goods and services class, and image classification.
The official database is available here: Israel Patent Authority – Trademarks Search.
A preliminary search can be useful for identifying identical or similar marks already on the register or pending before the Authority. It can also help identify marks owned by a particular company and review the goods and services covered by earlier applications or registrations.
What Should Be Checked Before Filing?
A useful pre-filing search should not be limited to an exact spelling of the proposed mark. Earlier marks may still be relevant where they differ in spelling but are similar in appearance, sound, meaning or overall commercial impression.
The search should also be considered in relation to the relevant goods and services. A mark that appears in a different class is not automatically irrelevant, and a mark in the same class is not automatically a bar to registration. The legal question depends on the marks, the goods or services, the relationship between them and the likelihood of confusion or another applicable ground of refusal.
Searching by Trademark Class
Israel uses the Nice Classification for goods and services. The public trademark database allows searches by classification, which can help narrow the results to commercially relevant fields.
However, a clearance search should not rely mechanically on a single class. Similar goods or services may appear in neighboring or commercially related classes, and the examiner may consider earlier rights outside the exact class selected by the applicant.
For more information on preparing the specification and selecting classes, see How to File a Trademark Application in Israel.
Searching Logos and Figurative Marks
Logo and figurative trademark searches can be more difficult than word-mark searches. The Israeli database includes image-classification fields that can be used to identify figurative elements, but the quality of the result depends on how the image is classified and how broadly the search is structured.
Where the proposed mark contains a logo, device, stylized element or other figurative feature, it may be appropriate to supplement a normal word search with a broader image-based or examiner-assisted search.
Official Search by the Israel Patent Authority
In addition to the free public database, the Israel Patent Authority offers an official search service under Regulation 78A. According to the Authority, a trademark examiner can conduct a search for a word or figurative mark to determine whether identical or similar marks appear in the Israeli trademark database.
The official service can also be used to search by owner name so that the report lists marks registered in the name of a particular owner.
The request is submitted to the Trademarks Department and is subject to the applicable official fee. The Authority states that the search report is generally provided within two business days.
Current filing instructions for the official search service are available here: Israel Patent Authority – Search the Israeli Trademarks Database.
Is an Official Trademark Search Required Before Filing?
No. A prior trademark search is not a mandatory condition for filing an Israeli trademark application. An applicant may file directly without first requesting an official search.
Nevertheless, a search can be commercially useful because it may reveal an obvious obstacle before filing fees and professional costs are incurred. It can also provide an opportunity to revise the mark, specification or filing strategy before the application becomes public and enters examination.
Does a Clear Search Guarantee Registration?
No. A search is an indication of potential conflicts, not a determination that the proposed mark is registrable.
During examination, the Israel Patent Authority considers additional issues including distinctiveness, descriptiveness, statutory grounds for refusal, the wording of goods and services, classification and earlier marks identified by the examiner. A mark may therefore receive an Office Action even if a preliminary search did not identify a blocking registration.
For the examination stage, see Trademark Examination and Office Actions in Israel.
Trademark Search vs. Legal Clearance Opinion
A database search identifies records. A legal clearance review goes further by assessing whether the identified marks are likely to present a practical objection, opposition or infringement risk.
For foreign trademark counsel, the useful question is often not only whether an earlier mark exists, but whether the similarity between the marks and the relationship between the goods or services creates a material risk under Israeli trademark law.
Drori Stav IP can conduct or review Israeli trademark searches, assess potentially conflicting rights and advise foreign counsel on filing strategy before an Israeli application is submitted.
Search Costs and Filing Strategy
The free public database can be searched without an official fee. The examiner-assisted search service is subject to an official fee, and professional clearance analysis is quoted separately according to the scope of the search and the number of marks or classes reviewed.
